1. Acceptance of Terms

By accessing and using Mall ("the Service"), operated at mall-topaz.vercel.app, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not access the Service.

2. Description of Service

Mall is a digital marketing and discovery platform that presents campaigns and offers in an interactive, infinite-scrolling grid format. The Service allows users to publish and manage their own campaigns through a dedicated dashboard. Publishers can use our tools to create custom campaigns with media, text, targets, and budgets that appear on the infinite canvas.

3. User Conduct

You agree not to:

  • Use automated scripts, bots, or tools to interact with campaigns or generate artificial traffic
  • Attempt to manipulate, hack, or reverse-engineer the Service
  • Click on campaigns fraudulently or encourage others to do so
  • Use the Service for any illegal purpose or in violation of any applicable laws
  • Interfere with or disrupt the integrity or performance of the Service

4. User Content and Campaigns

You are solely responsible for the content of the campaigns you publish (including text, media, targeting, and destination URLs). We do not endorse, guarantee, or assume responsibility for the accuracy, completeness, or reliability of any campaign content. Your interactions with other users or publishers found on the Service are solely between you and them.

5. Campaign Publishing & Refund Policy

Campaigns consume budget dynamically based on impressions and interactions. You can pause, edit, or delete campaigns through your dashboard, and transfer budgets appropriately using the platform features. Campaigns are subject to review. Campaigns containing misleading, illegal, adult (18+), or prohibited materials will be flagged and rejected. Payments and balances related to campaigns permanently rejected for severe policy violations will not be refunded.

6. Intellectual Property

The Service, including its original content (excluding campaign content provided by third parties), features, and functionality, is owned by Mall and is protected by international copyright, trademark, and other intellectual property laws. Campaign content is the property of the respective publishers.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free. We make no warranties about the accuracy or reliability of the campaign content displayed on the platform.

8. Limitation of Liability

In no event shall Mall, its owners, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service, any campaign content, or any products/services obtained through campaigns on the Service.

9. Modifications to Service

We reserve the right to modify or discontinue the Service at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

10. Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

11. Third-Party Integrations (Canva)

The Service includes an integration with Canva (the "Canva Integration") to facilitate ad design. By using the Canva Integration, you acknowledge and agree that:

  • You are also bound by **Canva’s Terms of Use** and **Privacy Policy**.
  • You are solely responsible for any content created within the Canva platform.
  • Designs imported from Canva into Mall are considered "User Content" and must comply with our content policies (Section 5).
  • We are not responsible for any issues arising from Canva's service availability or third-party features.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
